Resumo: o consentimento informado e o reconhecimento do seu estatuto constitucional como um direito fundamental encontram a sua justificação através de uma argumentação racional baseada na actual linguagem dos direitos. E esta tem a sua construção sólida e substancialmente consistente na cláusula aberta da Constituição Portuguesa e nas fontes éticas e jurídicas internacionais do consentimento informado.

Abstract: informed consent and the recognition of its constitutional status as a fundamental right, must be rationally based in the current language of rights. A solid and substantially consistent foundation can be built by means of the open clause of the Portuguese Constitution, as well as the ethical and legal international sources of informed consent.
