El tratamiento procesal en España del principio de confidencialidad en el marco de la Ley 5/2012, de 6 de julio, de mediación en asuntos civiles y mercantiles

Por todo ello, es capital analizar este principio a fin de constatar sus implicaciones en el procedimiento de mediación y su relevancia para que las partes alcance un acuerdo que ponga fin a su controversia.

Abstract: Confidentiality is a fundamental piece of mediation, since it is essential for its success. Since mediation is a method that aims to bring the divergent positions of the parties closer to obtain a friendly agreement, it is necessary to create a space of mutual trust in which the precautions with which each party transmits to each party must disappear, or at least be mitigated the other your own information or define your positions.

Consequently, it is essential that the information be limited to the framework of the mediation procedure. And this is because if you still did not go to it, the incentives to do so would be eliminated and if a procedure was already initiated, it would cause the parties to be very careful in selecting the information they pour into it, which would undoubtedly make it difficult to reach the end of Mediation.

Therefore, it is essential to analyze this principle in order to verify its implications in the mediation procedure and its relevance so that the parties reach an agreement that ends their dispute.
